1. Scope

These General Terms and Conditions (GTC) apply to all sales contracts that you conclude as a private customer or as a company via iamcreative.ch with Marein AG. By placing your order, you agree to these GTC.

2. Conclusion of Contract

The presentation of products on iamcreative.ch is not a binding offer, but an invitation to order. By completing your order, you are making a binding offer. The sales contract is concluded as soon as we confirm your order by email. If you do not receive a confirmation within a reasonable period, this is considered a rejection of the order – you are then free to order elsewhere.

3. Products

Please observe the warning notices on the packaging when using our products. Particular caution is advised for children under 3 years of age. We reject any liability claims (including for damage to material goods or animals) to the extent permitted by law.

4. Prices

Prices are quoted in Swiss Francs (CHF) and include Swiss VAT (8.1%), advance recycling fees, and our processing fees.

We reserve the right to change prices at any time. The prices published on iamcreative.ch at the time of your order apply to you.

5. Shipping and Delivery

5.1 Delivery Area and Delivery Time

We deliver exclusively within Switzerland. Delivery takes place as quickly as possible, usually within 1–2 working days. You can track the status of your shipment at any time via the link in the shipping confirmation.

In the event of temporary unavailability, subsequent deliveries will be made at no extra cost to you. On days with increased order volumes (e.g., before Christmas or school holidays), delivery times may be longer. We exclude claims for damages due to delayed delivery, provided there is no gross negligence on our part.

5.2 Shipping Costs

We charge a flat shipping fee of CHF 5.90 regardless of the actual effort. For orders of CHF 69.– or more, we deliver free of charge.

5.3 Shipping Service Providers

We ship with Swiss Post AG and DPD (Schweiz) AG.

5.4 Transport Damage

In the event of visible transport damage, we ask you to have the delivery person create an inventory report and to notify us of the damage immediately at info@marein.ch. We will then take care of a prompt solution.

6. Payment Methods

You can choose between different payment methods that are displayed at the time of your order during checkout. We currently accept:

• Credit card (Visa, Mastercard, American Express)
• TWINT
• Apple Pay / Google Pay
• Purchase on account (PowerPay) – see section 6.1

Payment processing is secure and encrypted via our payment service providers. We ourselves do not store complete payment data.

6.1 Purchase on account with installment option (PowerPay)

The "purchase on account" payment method is offered by MF Group AG (PowerPay) as an external payment service provider. Availability is subject to a positive identity and credit check by MF Group. Which options are available in each case is at the sole discretion of MF Group.

With the single invoice, you can simply pay for your purchase by invoice. If you do not pay the single invoice within the specified timeframe, you will receive a monthly invoice with an order summary the following month.

You will receive your invoice free of charge by email – a valid email address is a prerequisite. Upon conclusion of the contract, MF Group assumes the claim and handles the payment modalities.

By selecting "purchase on account," you accept the GTC of PowerPay/MF Group in addition to these GTC.

7. Notice of Defects and Warranty

7.1 Notice of Defects

Please check the goods immediately after receipt for quality and any defects. Please report defects to us within 8 days of receipt of the goods at info@marein.ch. Payment does not constitute a waiver of the right to report defects.

7.2 Warranty

We guarantee for a period of 24 months from delivery that the goods possess the assured properties and are suitable for their intended use (Art. 210 CO).

If a defect is present, we will provide a free repair or a replacement delivery at our discretion. Please return the defective goods to us in the original packaging and unused. If you have any questions, you can reach our customer service at info@marein.ch.

8. Voluntary Right of Return (14 days)

In Switzerland, there is no statutory right of withdrawal for online purchases. However, we voluntarily grant you a 14-day right of return if you do not like a product for any reason.

8.1 Conditions

• You report the return within 14 days of receiving the goods via the form.
• The goods are unused and in the original packaging
• Labels and any seals are undamaged

8.2 Return Costs

You bear the costs of the return yourself, unless the return is based on a defect or error on our part.

8.3 Refund

After receipt and inspection of the return, we will refund the purchase price to you within 14 days to the original payment method.

9. Express Replacement Guarantee (optional)

At checkout, you can add our Express Replacement Guarantee for an additional charge of CHF 3.95. With this, we will replace damaged, lost, or stolen shipments quickly and easily – without complex inquiries.

9.1 What is covered

If your shipment arrives damaged, is lost in transit, or is stolen during/after delivery, we will replace the goods for you – without requiring the return of the original shipment.

9.2 How it works

Simply send an email to info@marein.ch with:

• your order number
• a brief description of what happened
• in case of damage: a photo

After receiving your report, we will ship the replacement goods within 24 hours (on working days).

9.3 Reporting Deadline

So that we can help you quickly, please report the issue within 14 days of receipt or the expected delivery date. Unfortunately, we cannot consider reports received later under the Express Replacement Guarantee.

9.4 Not covered

The Express Replacement Guarantee does not apply to damage that occurs after you have received the goods (e.g., falls, liquids, improper use), nor to obvious abuse. Your statutory warranty rights remain unaffected by this.

10. Liability

We undertake to ensure security in our systems and programs that we have influence over in accordance with the current state of technology and to follow the applicable data protection regulations.

We are not liable for:

• Defects and malfunctions for which we are not responsible
• Security vulnerabilities and operational failures of third-party companies with which we cooperate or on which we depend
• Force majeure
• Improper use or disregard of risks by the customer or third parties
• Excessive strain or unsuitable operating resources of the customer or third parties
• Extreme environmental influences
• Interference by the customer or disruptions by third parties (e.g., viruses, worms, hacking attacks) that occur despite current security precautions

Otherwise, our liability for gross negligence and personal injury remains unaffected.

11. Data Protection

The collection, processing, and use of your personal data takes place within the framework of our Privacy Policy, which you can view at any time on iamcreative.ch.

12. Applicable Law and Place of Jurisdiction

These GTC and the contract with you are governed exclusively by Swiss law, excluding the UN Sales Convention.

The place of jurisdiction for both parties is Baden (Canton Aargau).

13. Final Provisions

Should individual provisions of these GTC be or become ineffective, the validity of the remaining provisions shall remain unaffected. The ineffective provision shall be replaced by the legally permissible regulation that comes closest to its sense and purpose.

We reserve the right to adapt these GTC at any time. The version valid at the time of the conclusion of the contract applies to your order.
